Terms of Service

1. The service

goongen.ai is an AI studio for photo editing, video generation and anime generation, running on GPU infrastructure. Access requires credits, purchased directly or redeemed from a credit code. Photo and Anime images cost a fixed number of credits per delivered image; Video runs in timed sessions that consume credits per minute. Credits do not expire. The free anime demo includes a limited number of free images per account and is rate-limited to prevent abuse. The service is provided as-is with no guarantees of availability or uptime.

2. Your content

You own everything you create. All content is end-to-end encrypted with keys only you control - we cannot see, review, moderate, or claim rights to your encrypted content. You are solely responsible for what you generate and how you use it.

3. Accounts, encryption & key management

• You create an account with an email address and a password (existing accounts created with a username only keep working). We send no verification or marketing emails. Your password never leaves your device - our login protocol proves it is correct without transmitting it.
• Your encryption key is stored encrypted on the server using a key derived from your password - we cannot decrypt it. Losing your password means losing access to everything you created; there is no recovery door, by design.
• You can additionally download a .pem key file as a backup credential. We strongly recommend doing so. If you lose both your password and your key file, your encrypted data is permanently inaccessible.

4. Payment & refunds

Credits can be purchased on the checkout with Bitcoin and other cryptocurrencies (processed by our self-hosted payment stack - no card data, no payment account linked to your identity), or obtained as a credit code, for example from one of our reseller partners. There are no subscriptions and no recurring billing. If something goes wrong on our end - such as a server or GPU failure that prevents you from using what you paid for - contact us and we will re-credit your account or find a solution.

5. Credit codes & reseller purchases

• Credit codes are single-use and have no cash value. Once redeemed, the credits belong to the redeeming account.
• If you buy a code from a reseller partner shop, the purchase and payment happen with that partner under their terms. We honor every valid code and handle technical issues (for example a code that will not redeem); payment disputes between you and the partner are resolved with the partner.
• Codes obtained fraudulently (stolen payment methods, chargeback abuse) may be invalidated.

6. Acceptable use

Your use of goongen.ai is subject to our Acceptable Use Policy. Violations may result in termination of access through public key and account-access revocation. Attempting to create or use another account to evade a permanent ban is prohibited.

7. Service availability

GPU capacity is provisioned on demand and subject to availability. We do not guarantee uptime, response times, or generation quality. Sessions may be affected by GPU supply constraints or infrastructure issues.

8. Termination

We may terminate access for violations of the Acceptable Use Policy. We may deactivate an account or permanently ban it. A permanent ban revokes sessions and may retain keyed hashes of the account email, known exact IP addresses, and a browser security signature to prevent re-registration. Associated encrypted data remains inaccessible to us and may remain retained with payment and audit records.

9. Limitation of liability

• The service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for content you create or how you use it.
• We are not liable for data loss resulting from lost passwords or lost key files.
• Our maximum liability is limited to the amount of your most recent purchase.

10. Indemnification

You agree to indemnify and hold harmless goongen.ai, its operators, and affiliates from any claims, damages, or expenses arising from your use of the service or content you create.

11. Changes to these terms

We may update these terms at any time. Continued use of the service after changes constitutes acceptance of the updated terms.

12. Governing law

These terms are governed by the laws of Switzerland. Any disputes will be resolved in the courts of Switzerland.

13. Affiliate & reseller programs

• The goongen.ai Affiliate Program allows participants to earn commissions by referring new users. Commission is calculated on the net sale amount (excluding VAT/tax) at the rate and for the payment methods shown on the affiliate signup page.
• Referred users are attributed to the affiliate for 90 days from the date of the initial referral click. All qualifying purchases within this window earn a commission. After 90 days, no further commissions are generated for that user.
• Self-referrals, fraudulent traffic, cookie stuffing, or any form of artificial inflation of clicks or sales is prohibited and will result in immediate termination from the program and forfeiture of unpaid commissions.
• The Reseller Program allows partners to buy credit codes at wholesale prices and resell them. Paid code packs are final sale. Resellers set their own prices and handle their own buyers' payments; we provide the codes and product support.
• We reserve the right to modify rates, terms, or terminate either program at any time. Active participants will be notified of material changes.
• Affiliates and resellers must not make misleading claims about goongen.ai, bid on our brand terms in paid advertising, or send unsolicited bulk messages.
