Terms of Service

1. The service

goongen.ai provides AI image editing on GPU instances. Access requires an invite code or payment. Sessions are time-limited (typically one hour). The service is provided as-is with no guarantees of availability or uptime.

2. Your content

You own everything you create. All content is zero-knowledge encrypted with keys only you control - we cannot see, review, moderate, or claim rights to your encrypted content. You are solely responsible for what you generate and how you use it.

3. Encryption & key management

• You can create an account with a username and password. No email is required. Your encryption key is stored encrypted on the server using a key derived from your password - we cannot decrypt it.
• You may also use a downloaded .pem key file as a backup or as your primary credential. If you rely solely on a key file and lose it, your encrypted data is permanently inaccessible.
• We strongly recommend both creating a password-based account and downloading a backup .pem key file.

4. Payment & refunds

Sessions can be purchased with Bitcoin or PayPal. If something goes wrong on our end - such as a server crash or GPU failure that prevents you from using your session - contact us for a refund. There are no subscriptions and no recurring billing.

5. Acceptable use

Your use of goongen.ai is subject to our Acceptable Use Policy. Violations may result in termination of access through public key revocation.

6. Service availability

GPU instances are provisioned on demand and subject to availability. We do not guarantee uptime, response times, or generation quality. Sessions may be affected by GPU supply constraints or infrastructure issues.

7. Termination

We may terminate access for violations of the Acceptable Use Policy. Termination is done by revoking your public key, which makes all associated encrypted data permanently inaccessible. We cannot selectively view or delete specific content - we can only remove your key entirely.

8. Limitation of liability

• The service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for content you create or how you use it.
• We are not liable for data loss resulting from lost private keys.
• Our maximum liability is limited to the amount you paid for your most recent session.

9. Indemnification

You agree to indemnify and hold harmless goongen.ai, its operators, and affiliates from any claims, damages, or expenses arising from your use of the service or content you create.

10. Changes to these terms

We may update these terms at any time. Continued use of the service after changes constitutes acceptance of the updated terms.

11. Governing law

These terms are governed by the laws of Switzerland. Any disputes will be resolved in the courts of Switzerland.
